Requirements for Short Code campaigns depend on the opt-in method.

We will work with you towards compliance. However, all opt-in methods need to state the following:

  • “Message and data rates may apply”

  • The specific expected message frequency the user will receive. (e.g., “1 message/day”, “5 messages/month”, “1 message/user request”)

  • “Text HELP to [your short code #] for help.” (note that HELP must appear in bold)

  • “Text STOP to [your short code #] to cancel.” (note that STOP must appear in bold)

  • URL of the SMS terms of service

  • URL of your privacy policy

Handset Opt-In

Double opt-in is a recommended best practice for opting in via a SMS or from a mobile app. The opt-in flow should resemble the following:

  • End users sees your Short Code advertisement

  • End user texts in the key word to your Short Code

  • Your app replies with: Welcome to [Company Campaign Name] [Description of Campaign]! Message and data rates may apply. [Message frequency] Reply HELP for help, STOP to cancel. [URL of the SMS terms of service] [URL of your privacy policy]

Non-Handset Opt-In

Double opt-in is mandatory for users opting in via any means other than from a mobile device (e.g., web site, paper registration, etc.). The opt-in flow should resemble the following:

  1. End users sees your Short Code advertisement and opts in via a non-mobile device

  2. End user receives a text from your Short Code stating: Reply “YES” to join [Company Campaign Name] [Description of Campaign]. Msg&data rates may apply. [Message frequency] Reply HELP for help, STOP to cancel. [URL of the SMS terms of service] [URL of your privacy policy]

  3. End user texts in the key word to your Short Code

  4. Your app replies with: Welcome to [Company Campaign Name] [Description of Campaign]! Message and data rates may apply. [Message frequency] Reply HELP for help, STOP to cancel. [URL of the SMS terms of service] [URL of your privacy policy]

Plivo will work with you and the carrier to help you become compliant, however it is important that our customer seek legal counsel on how laws and regulations apply to your company’s specific practices.
